Attorney Stanley Ference and the law firm of Ference & Associates have extensive experience with junk fax cases. Our law firm will evaluate your claim free of charge and advise you on your legal rights to collect compensation. There is no obligation to use our services, and we may take your case on a contingency basis (i.e., there is no fee unless we get money for you).
The Federal law passed in 1991 known as the Telephone Consumer Protection Act (TCPA) makes it illegal to send any material transmitted via facsimile that advertises the commercial availability or quality of any property, goods, or services which is transmitted to any person without that person's prior express invitation or permission. If the fax was deliberately sent to you (as most junk faxes are), federal law entitles you to recover a minimum of $500 and, depending the judge's discretion, up to $1,500 for each such fax that you receive. If you would like to review the text of the TCPA, you may do so by looking at Public Law 102-243; the relevant section is Section 227.
The Section 227 of the TCPA was amended in 2005 by the Junk Fax Prevention Act, Public Law 109-21, which permits faxes to be sent in certain circumstances. Among other provisions, the federal Junk Fax Prevention Act permits faxes to be sent to recipients with whom the sender has an established business relationship (EBR). Congress also required senders to provide an opt out mechanism, even for recipients with whom the sender has an EBR.
If you believe you have a claim under the TCPA, we would be pleased to conduct a free evaluation of your claim. In order to give you the best possible legal consultation, please provide us with a copy of the offending fax or faxes. You may submit your case for evaluation by email or mail using the information provided on the Contacting Us page of our website.
Many times, in order to give you a complete evaluation of your claim, we will need to speak with you on the telephone. Therefore, when submitting your case for evaluation, please be sure to provide us with a telephone number where you can be reached. Submission of your case for evaluation and any information contained in the submission is not privileged nor is it intended to create an attorney-client relationship between the sender and Ference & Associates.
