We recommend beginning any electronic discovery or computer forensic project
by consulting with a vendor of electronic discovery services. A consultation
should be tied to the attorney's case strategy and the client’s needs and objectives.
During the consultative process, the vendor will learn from the attorney and the client
about the specifics of the pending matter and can help guide the attorney to the most efficient,
cost-effective plan of action.
At the outset of a case, a vendor can provide guidance to help the attorney and the client:
(1) determine what data is required based on case law and reported decisions; (2) determine
what is technically feasible to collect; and (3) demonstrate to the court or opposition
that the electronic evidence strategy is appropriate to the case.
