What is a Class Action?

A class action is a type of lawsuit where one or more named plaintiffs bring a suit on behalf of a group of people who have suffered similar injury. Class actions avoid the necessity of each member having to bring an individual lawsuit. Class actions are used by the courts to resolve matters where the claims raise common issues of fact or law, making it fair and economical to resolve all claims at one time.

What is the Purpose of a Class Action?

Many class action lawsuits start from complaints by one or a handful of persons that affect many other persons. Class action lawsuits can advance several important public policy goals and remedy injustices. Where individuals would not be able to individually address these wrongs, a class action can effectively effect change.

Who is a Member of the Proposed DoubleClick Class?

The lawsuit against DoubleClick was filed as a nationwide class action; however, the Court needs to make a decision on whether to certify this action as a “Class.” The class that we have proposed consists of: All persons residing in the United States who have, while operating a computer, encountered an advertising banner issued by defendants having a style substantially in the form as those contained on this website. Excluded from the Class are defendants, its affiliates (including parents, subsidiaries, predecessors, successors, and any other entity or its affiliate which has a controlling interest), their current, former, and future employees, officers, directors, partners, members, indemnities, agents, attorneys and employees and its and their assigns and successors.

Will I be Responsible for Costs
or Attorney Fees in Pursuing This Claim?

No. Litigation costs will be advanced by the law firm. Litigation costs and attorney fees will be recovered only if the suit is successful, and then only out of the recovery obtained from DoubleClick and only in an amount that the Court determines is fair and reasonable.
