Stanley D. Ference III, the principal of Ference & Associates, has an extensive background in intellectual property litigation for both plaintiff and defendant. After working at a major New York City intellectual property firm, he joined the Intellectual Property Group of Pennsylvania's largest law firm. Mr. Ference is responsible for overall management and strategy of intellectual property litigation, including court appearances. He has argued before the Court of Appeals for the Federal Circuit, which has exclusive jurisdiction of patent appeals. Mr. Ference also has counseling and prosecution experience; this area of his practice emphasizes computer related technology.

Range of Experience

While intellectual property litigation is a significant portion of Mr. Ference's practice, he has a wide range of experience which encompasses a judicial clerkship, Social Security benefit litigation, and supporting Supreme Court nominations. His legal experience includes the following:

  • Experienced in all phases of intellectual property litigation. Responsible for formulation of overall litigation strategy and implementation of same from drafting complaints to preparation and arguing of post-trial motions.

  • Responsible for advising company charged with infringement in lawsuit over product developed in effort to successfully design around a valid U.S. patent. Favorable district court decision affirmed on appeal.

  • Groundbreaking lawsuit over use of meta-tags in web site to misdirect Internet search engines; case received extensive publicity, including articles in the Wall Street Journal and the National Law Journal. Also involved in various litigation surrounding enforcement of Network Solution's Domain Name Dispute Policy.

  • Trademark/trade dress/unfair competition litigation included counterfeiting cases. Experience encompassed drafting complaints to arguing pre-trial motions, obtaining ex parte temporary restraint and seizure orders.

  • Provided advice on intellectual property matters for clients ranging from start-up companies to Fortune 500 companies and internationally known universities. Areas of practice included patent prosecution and evaluation, trademark counseling and registration, copyright matters and trade secret protection

  • Exposed to all aspects of intellectual property, including preparation and filing of applications protecting intellectual property through litigation. Argued before the Court of Appeals for the Federal Circuit.

  • One of three partners in a firm with a distributed work environment; one person was in New York, one in Colorado and one in Pennsylvania. Practice emphasized Internet/computer related issues. Responsible for majority of firm trademark prosecution.

  • Handled all client contact from initial interview through conclusion of representation for disabled clients in Social Security and Veterans' benefit appeals. Profiled in The Pennsylvania Lawyer, The Dickinson Lawyer, and The NAPIL Connection (National Association of Public Interest Law Newsletter) for conception of a successful lawsuit involving miscomputation of Social Security benefits.

  • Reviewed motions and pleadings for compliance with court rules as a judicial law clerk. Researched and prepared memoranda on various legal issues.

  • Assisted in updating 1987 Freedom of Information Case List, and provided research assistance in support of litigation, policy development, and Supreme Court nominations. One of four first-year interns in group of seventy-five Summer Law Interns in Justice Department.
